Article 1: General Provisions
The seller's e-commerce webshop offers its customers the opportunity to purchase the products from its web store online. The present General Terms and Conditions ("Conditions") apply to every order placed by a visitor of this e-commerce webshop (“Customer”). Additional conditions of the Customer are excluded, unless they have been previously, in writing and expressly accepted.
Article 2: Price
All prices listed are expressed in euros and, unless otherwise indicated, include VAT. If delivery, reservation, or administrative fees are charged, this will be stated separately.
The price mention refers exclusively to the articles as verbally described. The accompanying photos are intended for decoration and may contain elements not included in the price.
Article 3: Offer
Despite the fact that the online catalog and the e-commerce webshop are assembled with the greatest possible care, it is nevertheless possible that the offered information is incomplete, contains material errors, or is not up-to-date. Apparent mistakes or errors in the offer bind us not. The seller is under no circumstance liable in case of manifest material errors, typeset or print errors. When the Customer has specific questions about e.g. sizes, color, availability, delivery term or method, we ask the Customer to contact our customer service in advance.
The offer always applies as long as the stock lasts and can be adjusted or withdrawn at any time. The seller cannot be held responsible for the unavailability of a product.
Article 4: Online Purchases
The Customer can choose between payment by bank card or credit card as payment methods.
The seller has the right to refuse an order due to a serious deficiency of the Customer with respect to orders in which the Customer is involved.
Article 5: Delivery and Execution of the Agreement
Any visible damage and/or qualitative deficiency of an article or other failure upon delivery must be reported immediately by the Customer.
The risk due to loss or damage passes on to the Customer from the moment he (or a third party designated by him, who is not the carrier) has physically obtained the goods.
Orders are always processed within 5 working days (working days are Monday - Friday) except if indicated otherwise in the shipping method or due to closing for holidays or vacation period. Closing for vacation period is always clarified on the webshop. Standard is the delivery term maximum 30 days, but in exceptional cases, the delivery term can increase. An exceptional situation can be that the products are not in stock. If the delivery term exceeds 30 days due to this reason, the customer will be informed. If there is another reason that affects and extends the delivery term beyond 30 days, the customer will be informed directly.
Article 6: Reservation of Ownership
The delivered articles remain the exclusive property of the seller until the moment of complete payment by the Customer.
Article 7: Right of Withdrawal
The provisions of this article only apply for Customers who purchase items online in their capacity as consumers.
The consumer has the right to withdraw from the contract within a term of 14 calendar days, unless otherwise indicated, without giving any reason, provided that the right of withdrawal applies to the ordered good or service by the customer. To exercise the right of withdrawal, the Customer must notify the seller of his decision to withdraw from the contract by an unequivocal statement (e.g., in writing by post, or e-mail) in a timely manner. The Customer must return or hand over the goods immediately, after his decision to withdraw from the agreement. The direct cost of returning the goods shall be borne by the Customer unless agreed otherwise.
If the returned product is diminished in any way, the right is reserved to hold the Customer accountable and demand compensation for any depreciation. Only items that are in the original packaging, along with all accessories, user manuals, and invoice or proof of purchase can be returned.
In case the contract involves the provision of services and if the Customer has requested the commencement of services during the withdrawal period, the Customer pays an amount that is proportional to what has already been delivered at the time he informed us of his decision to withdraw from the contract, compared to the full execution of the contract."
Article 8: Warranty
Under the law of 21 September 2004 regarding the protection of consumers in sales of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. To invoke the warranty, the Customer must present a proof of purchase.
The (commercial and/or legal) warranty never applies to defects that result from accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to follow the usage instructions or manual, modifications or changes to the article, rough handling, poor maintenance, or any other abnormal or incorrect use.
Article 9: Sanctions for Non-Payment
Without prejudice to the exercise of other rights, the Customer is, in the case of non- or late payment, from the date of the default automatically and without warning owed interest on the unpaid amount. Notwithstanding the foregoing, the right is reserved to take back the not (fully) paid items.
Article 10: Impairment of Validity - Non-Waiver
If any provision of these Conditions is declared invalid, unlawful or void, it shall in no way affect the validity, legality, and applicability of the other provisions. Failure at any time by the seller to enforce any of the rights listed in these Conditions, or any right to exercise them, will never be seen as a waiver of such provision and will never affect the validity of these rights.
Article 11: Amendment of Conditions
These Conditions are supplemented by other conditions that are explicitly referred to, and the seller's general sales conditions. In case of contradiction, present Conditions will prevail.
Article 12: Applicable Law
Belgian law is applicable. In case of legal disputes, the courts of the seller's domicile have jurisdiction. The seller can also turn to the ODR platform.
